The Commonwealth of Virginia has rules about all of that and more.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full\" src=\"https:\/\/cookattorneys.com\/wp-content\/uploads\/2023\/03\/What-is-a-fake-ID.png\" alt=\"What is a fake ID?\" width=\"1600\" height=\"1066\" \/><\/span><\/p>\n<h3><strong>What is a fake id?<\/strong><\/h3>\n<p><span style=\"font-weight: 400;\">A false or forged identification card is a concern to the government because of identity theft, voter fraud, benefits theft, and underage drinking.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Most people think of Driver&#8217;s Licenses when they think of fake IDs, but there are actually other documents that count in that category:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Driver License<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">State ID<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Social Security Card<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">US Passport<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Birth Certificate<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">US Armed Forces ID Card<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Foreign Visa<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Student ID<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">It is illegal to produce or to possess a false or forged identification card.\u00a0<\/span><\/p>\n<h3><strong>What is the penalty for getting caught with a fake ID?<\/strong><\/h3>\n<p><span style=\"font-weight: 400;\">The Commonwealth of Virginia is one of the strictest states about fake IDs, so it does not pay to take chances.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you are caught using a fake ID to buy alcohol when you are underage, you can be charged with both possessing or presenting a false ID and with unlawfully possessing alcohol, doubling the possible penalty you will be facing.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">If you are caught using someone else\u2019s ID as your own (even if the other person said it was okay), then you can be charged with a Class 6 Felony for identity fraud. This means you could do up to 5 years in jail.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Additionally, if you are convicted of possessing or using a fake ID, that conviction is never expunged from your record.
